1. Acceptance of Terms

By accessing or using CloviScan (the "Service"), operated by CloviScan ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and CloviScan. Your continued use of the Service following any modifications constitutes acceptance of the revised Terms.

2. Description of Service

CloviScan is a website security scanning and analysis platform that provides:

• SSL/TLS certificate validation and expiry monitoring
• HTTP security header analysis and scoring
• DNS configuration auditing and anomaly detection
• Malware and known threat signature detection
• Known vulnerability and exposure identification based on publicly disclosed data
• Security posture scoring and remediation recommendations powered by automated analysis

The Service is provided on an "as-is" and "as-available" basis. Features and functionality may change at our discretion. Scan results are based on passive analysis of publicly observable signals and known vulnerability databases; they do not constitute a comprehensive penetration test or security certification.

3. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Account Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Keep your credentials confidential and not share access with unauthorized parties
• Notify us immediately of any unauthorized use of your account at [email protected]
• Accept responsibility for all activities that occur under your account

5. Responsible Use and Authorization Requirement

CloviScan provides tools that interact with remote systems and infrastructure. You represent, warrant, and covenant that, for each target you submit for scanning or analysis:

• You are the legal owner of the target system, domain, or network; or
• You have obtained explicit, prior, written authorization from the legal owner or authorized administrator of the target system, domain, or network to conduct security scanning and analysis.

Authorization must be in place at the time of each scan and must remain valid for the duration of any recurring or scheduled scans. You must be able to produce evidence of such authorization upon request by CloviScan or any relevant legal authority.

Scanning systems without ownership or written authorization:

• Is a material breach of these Terms and will result in immediate account termination
• May violate computer fraud and abuse statutes, including the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and equivalent laws in other jurisdictions
• May expose you to civil and criminal liability entirely independent of your relationship with CloviScan

CloviScan reserves the right to investigate suspected unauthorized use and to cooperate fully with law enforcement authorities in connection with any such investigation.

6. Acceptable Use

In addition to the authorization requirements in Section 5, you agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to conduct offensive security operations, exploit vulnerabilities, or gain unauthorized access to any system
• Use scan results or reports to facilitate attacks, unauthorized intrusions, or malicious activity against any party
• Attempt to circumvent, bypass, or interfere with the Service's security features or technical limitations
• Use automated tools, bots, or scripts to access the Service in excess of normal usage patterns or in violation of rate limits
• Reverse-engineer, decompile, or disassemble any portion of the Service
• Resell, sublicense, or distribute the Service or its outputs without written authorization from CloviScan
• Use the Service to harm, defame, harass, or deceive any person or entity
• Submit false targets, fabricate authorization, or misrepresent ownership of any system

7. Security Scan Disclaimers

All scan results, security scores, vulnerability findings, and recommendations provided by CloviScan are based on automated analysis of publicly observable signals and known vulnerability databases. They are provided for informational purposes only.

CloviScan makes no warranty, representation, or guarantee that:

• Any scan will detect all vulnerabilities, misconfigurations, or security risks present in a target system
• A clean or passing scan result means the target system is free from vulnerabilities, malware, or security weaknesses
• Any recommendation, if implemented, will eliminate security risk or prevent a security incident
• Scan results reflect the current real-time state of any target system at the moment of review

CloviScan is not a substitute for professional penetration testing, a security audit, or ongoing security monitoring by qualified security personnel.

8. Intellectual Property

The Service, including its software, design, content, and trademarks, is owned by CloviScan and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service solely as permitted under these Terms.

You retain all ownership rights to data you submit to the Service. By submitting targets, you grant CloviScan a limited license to process that data for the purpose of providing the Service to you.

9. Third-Party Data and Services

The Service may incorporate data and functionality from third-party providers, including vulnerability databases, threat intelligence feeds, SSL validation services, and DNS analysis services. CloviScan does not control and is not responsible for the accuracy, completeness, or timeliness of third-party data. Your use of the Service is subject to the constraints of those data providers' licensing terms.

10. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you authorize CloviScan (through its designated payment processor) to charge the applicable fees to your payment method. Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected). All fees are non-refundable except as required by applicable law or as expressly stated in a separate refund policy.

CloviScan reserves the right to modify pricing upon reasonable notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

11. Termination

Either party may terminate these Terms at any time. You may terminate by discontinuing use of the Service and closing your account. CloviScan may suspend or terminate your access immediately, without prior notice, for any material breach of these Terms — including any violation of the authorization requirements in Section 5 — fraudulent activity, or conduct that may harm the Service or other users. Upon termination, your right to use the Service ceases immediately.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. CLOVITEK AI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SCAN RESULTS WILL BE COMPREHENSIVE OR FREE FROM FALSE POSITIVES OR FALSE NEGATIVES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOVITEK AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS DISRUPTION, OR DAMAGES ARISING FROM SECURITY INCIDENTS, UNAUTHORIZED ACCESS, OR RELIANCE ON SCAN RESULTS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CLOVITEK AI'S TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO CLOVITEK AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

14. Indemnification

You agree to indemnify, defend, and hold harmless CloviScan and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms, including the authorization requirements in Section 5; (c) your violation of any third-party rights; or (d) any claim by a third party that you scanned their systems without authorization.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, unless you opt out in writing within 30 days of first accepting these Terms. Class action waivers apply to the fullest extent permitted by law.

16. Changes to These Terms

CloviScan reserves the right to modify these Terms at any time. We will notify registered users of material changes by email or by posting a notice within the Service. Your continued use of the Service following the effective date of any modification constitutes your acceptance of the updated Terms.
